1. Definitions

  1. “CareerDNA” means a third party partner platform offering data-driven career and salary insights;
  2. “GUVI” means an Edtech platform provided by a third-party partner, offering a comprehensive suite of learning solutions for self-led and instructed orchestrated learning. It includes interdisciplinary tech tracks, immersive labs and domain infused projects for industry readiness.
  3. “Growthrive” means Growthrive Private Limited a licensee of OMV and the LvLUP product;
  4. “Kalido” means an AI-powered talent platform that enables users to create profiles, discover members with shared interests and skills, find and/or become mentors, match to job and upskilling opportunities and get personalized guidance for skills and career development.
  5. “LvLUP” means LvLUP, an artificial intelligence (“AI”) career assessment tool. LvLUP is a product and brand of OMV;
  6. “Materials” mean all of the material on LvLUP Website, including but not limited to the texts, drawings, data, video content and information;
  7. “Products” mean the LvLUP offerings available on the Website including LvLUP career reports, Resume Builder and third party offerings such as CareerDNA and GUVI educational courses;
  8. “Our”, “We” and “Us” means Om Mobile Ventures Limited or, when services are purchased by Indian residents, our licensee Growththrive;
  9. “Resume Builder” means our AI enabled offering whereby you can build a resume using your existing CV or inputs with professional layouts and career insights;
  10. “Terms” mean these Website Terms and Conditions for using the Website and forming a binding agreement between Us and the User;
  11. “Trade Marks” collectively mean the trade marks, names, brands, logos and domain names of OMV, LvLUP;
  12. “SAWiT” means a community of South Asian Women in Technology.
  13. “Website” means the official Website for LvLUP located at www.lvlup.kalido.com, or any OMV related websites;
  14. “you” or “User” or any derivative of the word; mean any person, natural or otherwise, acting in their personal capacity or otherwise and accessing, logging-in, registering, viewing or using the Website.

2. Introduction

  1. This is the Website for LvLUP. LvLUP, leverages AI to generate a career assessment report based on your inputs through uploading a curriculum vitae (“CV”) and offers AI enabled resume building services through Resume Builder;
  2. We provide the information contained in this Website and the pages comprising the Website and offer the Products including those of third parties, subject to the Terms and conditions set out herein.
  3. Please read these Terms, they will govern our relationship with you, as a User, in relation to your use of the Website and will constitute an on-going binding agreement between us. You should also read our Privacy Policy (“the Policy”) which is incorporated into these terms by reference.

3. Acceptance of Terms and Standard Terms and Conditions

  1. By accessing or registering on the Website, you are deemed to have read, understood and agreed to the Terms and the Policy. We may at any time modify any of the Terms and such modification will supersede and replace any previous Terms. The amended Terms will be made available on the Website. Each time you access the Website, you agree to be bound by the Terms, as they have changed.
  2. If you do not accept these Terms, please do not continue to use this Website. Please note that the Terms stated in this document refer to the use by You of this Website and are not related to any commercial agreement concluded between you and OMV or any other third party, including any payment portals, pursuant to the use of this Website.
  3. Our partner services are in terms of the partners terms and conditions to which apply to those services. If you use GUVI, Kalido or any other partner services you will also agree to and be bound to their terms and conditions and privacy notice which may be based in another jurisdiction and subject to other laws.

4. Content of the Website

  1. While We make every effort to update the Material provided on the Website on a regular basis, We make no representations or warranties, whether express, implied in law or residual, as to the accuracy, completeness or reliability of any Material, information, data and/or content on the Website.

5. Pricing & Products

  1. LvLUP reports are offered for purchase at a once-off fee here lvlup.kalido.me/lvlup. The pricing may differ from jurisdiction to jurisdiction. You will be required to pay the fee based on your location.
  2. Your LvLUP report may contain suggested upskilling and courses via our third party partner GUVI. You may purchase online courses at the discount for self learning and live courses specified in your order form.
  3. When you purchase and your Users make use of any Services provided by our partner GUVI you and they will be bound by GUVI’s terms here: https://www.guvi.in/terms-of-service/. You may not sign up for or use any Services provided by our partner GUVI unless you agree to be bound to the above terms and privacy policy.
  4. Your LvLUP report may suggest career data insights and benchmarking via our partner CareerDNA. You will be required to register for a CareerDNA account if you chose to use this Service via the sign in link. You will have to agree to their terms to make use of the Service.
  5. Resume Builder is are offered for purchase at a once-off fee here https://lvlup.kalido.me. The pricing may differ jurisdiction to jurisdiction. You will be required to pay the fee based on your location.

6. Use of the Website and indemnification

  1. All users have access to the public and non-member Products and areas of the LvLUP website.
  2. If you are a registered Kalido or SAWIT user you will be able to login to LvLUP with your Kalido or SAWIT login details. If you are not, you will be required to register to gain access to the full functionality of the Website, including purchasing Products.
  3. By accessing the Website, you warrant and represent to Us that you are legally entitled to do so. If you purchase any of our Products you warrant and represent that you are legally authorised to do so and are of legal age to enter into a contract.
  4. You further warrant you will not use the Website, the Products or any Material made available or sent to you by us pursuant to your use of the Website for any purpose that is unlawful or prohibited under the laws of England and Wales or international law or is contravention of the Terms.
  5. Further you agree that you will not use LvLUP or the Website for any commercial or resale purposes unless you have entered into an enterprise agreement with Us.
  6. You hereby expressly indemnify Us against any loss, liability, damage or expense of whatever nature which We or any third party may suffer which is caused by or attributable to, whether directly or indirectly, a breach by you of any of the warranties in these Terms or of any laws which bind either Party. Further, We shall be held harmless against any loss or damage, how ever it may arise suffered by you or any third party as a result of your use of the Website, Materials or Products. You use the Website, access the Materials and Products.
  7. We may modify, withdraw or deny access to this Website at any time.
  8. You may print pages for your personal use but no part of this Website may be reproduced or transmitted for any other purpose.
  9. This Website is not intended to provide exhaustive treatment of any subject. The information on this Website including all research, opinions, reports or other Material is not intended to and do not constitute financial, accounting, tax, legal, investment, career, consulting or other professional advice or services.   11. You agree not to use LvLUP to break any laws, or act in a generally unpleasant way. ‘Unlawfulness’ and ‘unpleasantness’ include, but are not limited to:
    1. Breach or infringement of copyright, data privacy, contract, intellectual property, and all other applicable local and international laws;
    2. Behaviour that jeopardizes your, or any other User’s, or Our safety. For example, you shouldn’t allow anyone else to log in to your personal profile or share your login details (this could harm you). You also shouldn’t use anyone else’s personal information or CV;Breach of any applicable policies;
    3. Modifying the Website;
    4. Accessing the Our servers, communications, or data using anything other than an unmodified Website;
    5. Activity designed primarily to overload Our servers, or otherwise negatively affect other Users experience.
  12. Users are encouraged to report untrue, inaccurate, defamatory, illegal, infringing and/or harmful content or any We undertake to correct and/or remove such Material or content or any part thereof if the person reporting such content provided reasonable grounds to prove the alleged nature of the content.
  13. We may temporarily or permanently limit or terminate your access to the Website, or access to Products if you are suspected to be in breach of these terms.

  1. Copyright and all intellectual property rights and all Materials are owned by Us, alternatively We are the lawful users thereof.
  2.   3. The Trade Marks displayed on this Website and/or App are registered and unregistered trade marks of OMV or an authorised third party. Nothing contained on this Website should be construed as granting any licence or right to use any trade mark without Our prior written permission.

Any Material available on the website that is subject to the Copyright of a third party is used either with with third Parties consent or is used in terms of the principles of fair use and only for informational or education purposes.   5. You may provide us with feedback through the Website. By sharing feedback with us you are granting us, and our third party partners to the extent such feedback relates to their Products, a license over your feedback. This license, as applicable, is royalty-free, sub-licenseable, irrevocable, and worldwide, provided that when you delete your account, we will stop displaying your feedback.

8. AOL (Ambassadors of LvLUP) Partner Program

  1. We offer the opportunity to become an Ambassador of LvLUP (”AOL”). Ambassadors are independent partners who promote LvLUP's career development tools. AOLs can earn income through commissions on direct sales and by building a team of fellow AOLs.
  2. When you apply to be an AOL you will be bound by our AOL terms and conditions found here: https://lvlup.kalido.me/aol-partner-program as well as our Code of Ethics and Rules of Conduct.

9. Permission to link to our Website

Nobody may establish a hyperlink, frame, meta tag or similar reference, whether electronically or otherwise (collectively referred to as linking), to this Website or any subsidiary pages before receiving Our prior written approval, which may be withheld or granted subject to the conditions We specifie from time to time.

10. Warranties, disclaimers and limitation of liability

  1. You warrant that the data in the uploaded CV is correct and up to date. While our analysis leverages powerful AI to process complex career data and market trends, we recommend using these insights as one of several inputs to career planning. We provide no warranty as to the accuracy, fitness for purpose or applicability to the CV-owners specific situation as it may not reflect human expertise. Our predictions and recommendations should be considered alongside your personal experience, professional judgment, and consultation with industry mentors and career advisors.
  2. Save as set out in the Terms, We make no warranties, representations, statements or guarantees (whether express, implied in law or residual) regarding the Website and the, Products, Materials. The Website and Products made available via the Website are provided "as is".
  3. We do not make any warranty or representation that Material and Products, and any third party Products available on the Website are appropriate for use in any jurisdiction.
  4. To the fullest extent possible by law, We expressly disclaim all (express or implied) warranties, including, without limitation, warranties and non-infringement, compatibility, security and accuracy in respect of this Website. We do not warrant that the Website or any software available for download via the Website, if any, is free of viruses or destructive codes.

Without limiting the generality of the aforegoing, neither OMV nor its board of directors, officers, employees, licensor or representatives shall be liable for any loss of business, income, loss of data and/or loss of profits, any failure and/or unavailability of the Website or Products for any reason whatever and/or the failure/delay by any third party service provider to render any service/s which are necessary to ensure the availability of the Website or its ancillary functions.

We will not be liable for any loss, harm or damage suffered by you as a result of transmitting information to us unless such liability is conferred upon us by legislation.

11. Cancellation and refunds

  1. No refunds will be provided for LvLUP reports, due to their nature as a final deliverable, and all payments under this Agreement will be irrevocable, non-refundable, and non-creditable.
  2. You acknowledge that any additional Products including educational courses through GUVI or CareerDNA, are non-refundable once purchased.

12. Law & Jurisdiction

We have offices in London, United Kingdom and the Material related to the Products featured on this Website are based on the laws of England and Wales unless otherwise expressly stated. Your use of this Website and any dispute arising out of the Website is subject to the laws of England and Wales . Should a dispute arise about these Terms, or about something related to these Terms, the dispute will be addressed in London, England, in English, and held in accordance with the London Court of International Arbitration mediation rules. The applicable law will be that of England and Wales. To keep things clear, use of LvLUP and the Website, and the acceptance of these Terms constitutes consent to the exclusive jurisdiction and venue in the state or federal courts located in, respectively, London, or the United Kingdom.
